A third telco bidder – NOW Telecom – has filed a case against National Telecommunications Commission (NTC) for an allegedly unlawful requirement in the final selection of the Philippines’ third telco player.

The said requirements include: Php700-million Participation Security; Php14-billion to Php24-billion Performance Security; and Php10-million non-refundable Appeal Fee. NOW Telecom also claimed that NTC didn’t mention these requirements during their public hearings.

According to the company, these provisions will serve as “barriers to the entry” of companies hoping to be the next network provider of the country.

Meanwhile, Department of Information and Communications Technology (DICT) Acting Secretary Eliseo Rio Jr. addressed that this complaint might delay their selection process, although the government eyes to announce the new telco company before the year ends.

On the other hand, the bidder's parent company – NOW Corp. – explained that they are suing NTC “to protect its shareholders and President Rodrigo Duterte from any suspicion that he is complicit to the money making schemes in the TOR for the third telco.”
